WHEREAS , A . C . A . § 16- 17-111 authorizes municipalities to levy and collect a sum not to exceed five dollars from each defendant in certain municipal court cases to be used in the administration of the municipal court ; and WHEREAS , the City of Fayetteville deems it necessary to levy such amount as allowed by law to support the administration of its municipal court . NOW THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYEITEVILLE , ARKANSAS : Section 1 . That in addition to all other costs provided by law , the City of Fayetteville hereby authorizes and directs the Fayetteville Municipal Court to levy and collect from each defendant upon each plea of guilty or nolo contendere , forfeiture of bond , or determination of guilt for misdemeanors or traffic violations an amount of five dollars ( $ 5 . 00 ) as set forth in A . C . A . § 16-17-111 . Section 2 . That this additional court cost shall be applied to all such cases regardless of whether the violation occurred within or outside the Fayetteville city boundaries . Section 3 . That the monies collected by the levy of this additional court cost shall be deposited in the city treasury and the portion of the court costs to be retained by the city and the portion to be received by the county shall be set forth in an agreement to be negotiated between the Board of Directors of the City of Fayetteville and the Washington County Quorum Court . Section 4 . That the funds collected by this additional court cost may be used for any permissable use in the administration of the municipal court including but not limited to salaries and cost of incarceration of defendants . Section 5 , The Board of Directors hereby determines that the immediate passage of this ordinance is necessary to provide said administrative services . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
