AN ORDINANCE LEVYING THE FRANCHISE TAX PAYABLE
BY THE CITY OF FAYETTEVILLE WATER AND SEWER
FUND .
BE IT ORDAINED BY THE BOARD OF DIRECTQk OF THE ffg ,,, OOF�
FAYETTEVILLE , ARKANSAS : l ��
Section 1 . That the Water and Sewer Fund shall pay
annually to the City of Fayetteville a lump sum , in addition to the
current 3% of annual total gross water revenues , equivalent to
$ 1 , 282 , 000 from water sales as a franchise tax for the years 1990 -
1997 for the privilege of operating a water transmission system
within the street , avenues , alleys , roads , and highways , and the
public places within the City of Fayetteville .
Section 2 . That the Water and Sewer Fund shall pay
annually to the City of Fayetteville a lump sum , in addition to the
current 3 % of annual total gross sewer charges revenues , equivalent
to $ 98 , 000 from years 1990 - 1998 for the privilege of operating a
sewer collection system within the street , avenues , alleys , roads ,
and highways , and the public places within the City of
Fayetteville .
Section 3 . That the Water and Sewer Fund shall pay to the
City of Fayetteville a lump sum , in addition to the current 3 % of
annual total gross water revenues , equivalent to $ 92 , 000 from water
sales as a franchise tax for the year 1998 for the privilege of
operating a water transmission system within the street , avenues ,
alleys , roads , and highways , and the public places with the City of
Fayetteville . .
Section .4 . . .,This ' franchise tax shall take effect and
continue And remain in 'force until December 1998 .
Section 5 . The ' Board of Directors hereby determines the
these franchise taxes are required for the continuing use of public
streets , avenues , alleys , roads , and highways , and the public
places within the City of Fayetteville and is essential to the
public welfare.. . . Therefore , an emergency is hereby declared 'to
exist , and this ordinance being necessary for the public health ,
safety and welfare shall be in full force and effect from and after
its passage and approval .
