ORDINANCE NO . 3499
AN ORDINANCE VACATING AND ABANDONING A POR ON

WHEREAS , the Fayetteville Board of Directors has the
authority to vacate and abandon public utility easements and ,
WHEREAS , the owners of the real estate containing the portion
of the easement hereinafter sought to be abandoned and vacated
have petitioned the City for the abandonment and vacation of such
easement and ,
WHEREAS , the public utilities have agreed to the vacation as
requested and the City has no utilities in the easement nor
anticipates any utilities in the easement .
NOW THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . The Board of Directors hereby vacates and
abandons all of the city ' s rights , together with the rights of the
public generally , in and to a triangular shaped portion of an
existing easement that has been encroached upon by a residential
dwelling at 2417 Lensfield on Lot 18 , in the Park Place Addition ,
Phase III to the City of Fayetteville , Washington County ,
Arkansas . Said easement is further described on the attached
survey plat which is attached hereto and made a part hereof .
PASSED AND APPROVED this 21st day of August 1990 .
