AN ORDINANCE AMENDING CHAPTER 51 OF- THE 1 1001911 ED
REVISED EDITION OF THE CODE OF FAYETTEVILLE
( CHAPTER 21 OF THE CODE OF ORDINANCE . CITY OF
FAYETTEVILLE , ARKANSAS ) , MONTHLY WATER AND
SEWER RATES , ABNORMAL SEWAGE SURCHARGES , AND
WATER TANKS ON COMMERCIAL TRUCKS RATES .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That § 51 . 136 ( A ) l of the Code of Fayetteville
021 - 25 of the Code of Ordinances ) is hereby amended by amending
the schedule of monthly treated water rates to read as reflected
in Exhibit "A" attached hereto and made a part hereof .
Section 2 . That § 51 . 136 ( 2 ) ( B ) ( 1 ) ( a ) of the Code of
Fayetteville ( § 21 - 25 of the Code of Ordinances ) is hereby amended
by amending the schedule of monthly meter service charges to read
as reflected in Exhibit " B" attached hereto and made a part
hereof .
Section 3 . That § 51 . 1360 ) ( 1 ) ( 2 ) ( 3 ) of the Code of
Fayetteville ( § 21 - 25 of the Code of Ordinances ) is hereby amended
by amending the schedule of monthly standby fire protection
service charges to read as reflected in Exhibit " C " attached
hereto and made a part hereof .
Section 4 . That § 51 . 136 of the Code of Fayetteville ( § 21 -
25 ( £ ) of the Code of Ordinances ) is hereby amended by adding
§ 51 . 136 ( f ) as follows :
( F ) Monthly charge for fire hydrants provided water by
the city of Fayetteville for municipalities and / or
districts outside the city limits of Fayetteville .
Effective August 1 , 1990 :
$ 7- . 00 per hydrant per month .
Section 5 . That § 51 . 137 ( A ) ( 1 ) and ( 2 ) of the Code of
Fayetteville . ( § 21 - 26 ( a ) of the Code of Ordinances ) is hereby
amended by amending the schedule of monthly quantity charges and
monthly service charges to read as reflected in Exhibit "E"
attached hereto and made a part hereof .
Section 6 . That § 51 . 137 ( B ) ( 2 ) ( a ) of the Code of
Fayetteville ( § 21 - 26 ( b ) of the Code of Ordinances ) is hereby
amended by amending the schedule of monthly residential sewer rate
within Wedington Sewer Improvement District No . 1 of the city who
do not receive city water services to read as reflected in Exhibit
" F " attached hereto and made a part hereof . n

Section 7 . That § 51 . 138 ( A ) ( 3 ) of the Code of Fayetteville
( § 21 - 26 . 1 of the Code of Ordinances ) is hereby amended by amending
the schedule of unit charge to read as reflected in Exhibit "G"
attached hereto and made a part hereof .
Section 8 . That § 51 . 144 ( A ) of the Code of Fayetteville
( Ordinance No . 3478 , passed 4 - 3 - 90 ) is hereby amended by amending
the schedule of water rates to fill water tanks on commercial
trucks charges to read as reflected in Exhibit "H" attached hereto
and made a part hereof .
Section 9 . The Board of Directors hereby_ determines that
the present water rates do not provide sufficient revenues for the
City to provide adequate water service ; the provision of adequate
water service is essential to the public health , safety and
welfare ; and that the immediate passage of this ordinance is
necessary for the City to generate sufficient revenues to provide
adequate water service . Therefore , an emergency is hereby
declared to exist and this ordinance be necessary for the public
health , safety and welfare should be in fu-i1 force and effect upon
passage and approval .
