KOLLMEYER ORDINANCE NO . _ v4R7 N11CRDFILMED AN ORDINANCE AUTHORIZING OMI TO PURCHASE AND INSTALL REPLACEMENT GEAR HOUSING ON PRIMARY CLARIFIER NO . 1 AND WAIVING COMPETITIVE BIDDING ON ITS PURCHASE . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . The Board of Directors hereby authorizes OMI to purchase and install replacement gear housing to repair Primary Clarifier No . 1 at a total cost not to exceed $ 24 , 500 . 00 . Section 2 . That the Board of Directors waives the requirementsof competitive bidding for the purchase of the aforementioned repair parts for t4-e reason that said requirements are not practical or feasible due to the emergency nature of the needed repairs , and that .,the parts,: aie available only from a single source . Section 3 . The Board of Directors hereby determines that the City of Fayetteville is in immediate need of the purchase and installation . of such replacement parts and hereby determines that the immediate passage of this ordinance is necessary in order to carry out such repairs . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
