KOLLMEYER ORDINANCE NO . 3483 pfVLM5, AN ORDINANCE WAIVING THE REQUIREMENTS 0r COMPETITIVE BIDDING AND AWARDING A CONTRACT FOR BRUSH REMOVAL TO FULTON SANITATION . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . The Board of Directors hereby waives the OJf requirements of competitive bidding for removal of brush from the City ' s 15th Street lot for the reason that said requirements are N not feasible or practical in order to commence and complete the removal in a prompt and efficient manner . Section 2 . That the Mayor and City Clerk are authorized and directed to execute a contract with Fulton Sanitation for brush removal from the City ' s 15th Street lot . A copy of the contract authorized for execution is attached hereto marked Exhibit " A" and made a part hereof . _ Section 3 . The Board of Directors hereby determines that the immediate removal of said brush is necessary for the public health , safety , . and welfare and hereby determines that the immediate passage of this ordinance is necessary to provide for its removal . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
