AN ORDINANCE WAIVING THE REQUIREMENT OF 1 . 5
ACRES MINIMUM LOT SIZE FOR A LOT SPLIT OF
PROPERTY LOCATED AT KENDALL ROAD AND EAST
SALEM ROAD .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the Board of Directors hereby waives the
1 . 5 acre minimum lot size requirement for two lots located at
Kendall Road and East Salem Road as described in Exhibit " A"
attached hereto and made a part hereof .
v Section Z . That the official zoning map of ' the City of
Fayetteville , Arkansas including the City ' s growth area , is hereby
amended to reflect the zoning change provided in 'Section ' I above .

SUBJECT : Request for Waiver of Minimum Lot Size
Ken Hatfield Lot Splits ( 2 )
Kendall Drive ( Outside City Limits )
Kenneth Hatfield submitted two lot splits to the Planning
Commission for their consideration on April 9th , 1990 . The location
of the splits is off County Roads 894 and 2039 ( see attached Plat ) .
The lots created by the splits are approximately 1 . 2 acres in
size . Since there is no public sewer available , our ordinances
require the lots to be at least 1 . 5 acres before an individual
treatment system ( septic tank ) can be allowed . The Planning
Commission did approve the splits subject to subsequent waiver of
the 1 . 5 acre requirement by the Board of Directors .
Therefore , Mr . Hatfield is requesting a waiver of the 1 . 5 acre
minimum size requirement for each of the new lots created by the
splits . The request is based on the fact that ' the Health Department
has approved each of the lots for septic tanks . The Health
Department requires that lots have sufficient room for a septic
tank and lateral lines based on the percolation data , and that
sufficient room exists on the lot for an alternate system should
the original system fail .
Mr . Doug Hemingway of Fayetteville will represent Mr .
Hatfield ' s interest in this matter .
