That the Board of Directors hereby waives the requirements of competitive bidding for the purchase and installation of a waste compactor for the reason that said requirements are not feasible or practical due to the immediate need of the equipment for the public health safety and welfare and the lengthy nature of competitive bidding requirements . �O Section 2 . Kelly , Public Works Director DATE : February 26 , 1990 SUBJECT : Response to Northwest Arkansas Landfill Closure Last week the Arkansas Department of Pollution Control and Ecology announced revocation of ' Northwest Arkansas Waste Management , Inc . ' s landfill permit as of March 2 , 1990 . Under the emergency order Northwest Landfill would not be able to receive refuse beginning March 15 , 1990 . This action has forced City staff to begin implementation of the City solid waste disposal contingency plan . As part of this plan , the City is contracting with Crafton , Tull and Associates for the design of an emergency solid waste transfer and recycling station . As you are aware , landfill capacity in Northwest Arkansas is extremely limited . Fulton Sanitation in Rogers will reach capacity in November 1990 based on current service levels . Similarly , Sunray Services in Tontitown has a capacity of about 1 1 /2 years at the current level of service . If Sunray were to accept Fayetteville ' s present waste stream , capacity would be reached in less than one year . There are no other landfills close enough to which Fayetteville could haul uncompacted tyr waste economically and efficiently . � N The Northwest Arkansas Regional Solid Waste Planning Board is developrg a regional solid waste management plan to a ress this 5 �Vv dilemma . As an active participant in this regional planning process , the City of Fayetteville have adopted solid waste management strategies consistent with the regional plan . City staff have been in close y communication with the Regional Solid Waste Management Planning Board and have been reassured that a publicly owned transfer and recycling facility in Fayetteville will be an integral part of the finished plan , and consequently eligible for substantial reimbursement through the State Solid Waste Management and Recycling Fund grant program . A principle strategy of both the City and the Regional Solid Waste Planning Board is to maximize flexibility by maintaining as many disposal options as possible . The lack of multiple disposal facilities nearby in North ns s necessitates the construction of a publicly owne transfer and recycling facile y to open up disposal options further from he City lima s . when a new disposal facility is sited in the Northwest Arkansas region , it is likely to be further from Fayetteville than the current landfills . If this is true , a publicly owned transfer and recycling facility in Fayetteville will be essential in providing efficient , cost efficient and environmentally sound waste reduction and disposal for City residents . In addition , the City will recognize significant cost savings in reduced crew and fleet time . As you are aware , landfill capacity in our region is extremely limited within the distance uncompacted waste can be economically and efficiently hauled . Given the immediacy of the situation , the City of Fayetteville has little choice but to proceed with the construction of a transfer and recycling facility to insure efficient , cost-efficient and environmentally sound solid waste reduction and disposal for the residents of Fayetteville . Whereas the City of Fayetteville is firmly committed to the Northwest Arkansas Regional Solid Waste Management Plan currently under development , it is the intent of the City that any such facility be an integral part of the regional solid waste management solution in the context of cooperation and shared resources , as described in Act 934 , the Solid Waste Management and Recycling Fund Act of 1989 . The City of Fayetteville hereby serves notice of its intent to build a transfer and recycling facility to accommodate the current solid waste stream of the City , to facilitate recycling efforts within the City as a functional part of the solid waste management system , and to serve as an integral part of the Northwest Arkansas Regional Solid Waste Management Plan , A Solid Waste Management and Recycling Fund grant application with the full concurrence of the Northwest Arkansas Regional Solid Waste Management Planning Board will be forthcoming from the City as soon as possible . Because of the dire circumstance , the City must move with utmost expediency to insure the health , welfare , and economic well -being of its residents . The City respectfully requests that due consideration be given to the grant application for retroactive reimbursement to the maximum extent possible under the provisions and intent of Act 934 . Fayetteville is grateful for the State ' s assistance in implementing this important component of regional recycling and solid waste reduction in Northwest Arkansas .
