KOLLMfYER AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR"'CROf THE PURCHASE OF A SCADA SYSTEM AND A PERMANENT SEWER FLOW MONITORING SYSTEM . WHEREAS , the highly technical nature of the equipment to be purchased for the system makes normal competitive bidding infeasible , and WHEREAS , on the advise of the pro? ect engineers , ETC Engineers , Inc . , bidders for said equipment should be prequalified before participating in the bidding process , and WHEREAS , the purchasing rules and regulations for the City of Fayetteville do not formally recognize such prequalifications as a competitive bid . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF F.AYETTEVILLE , ARKANSAS : 0- Section 1 . That the Board of Directors waives the requirements of competitive bidding for the purchase of a SCADA System ( Pump Station & Tank Telemetry ) and a Permanent Sewer Flow Monitoring System to allow for a prequalification of vendors for the exceptional circumstances that the highly technical nature of such equipment makes normal competitive bidding unfeasible . Section 'l . The Board of Directors herebv determines that the immediate procurement of such equipment is necessary for the public health . safety and welfare and hereby determines that the immediate passage of this ordinance is necessary to so procure that equipment . Therefore an emergency is hereby declared to exist and this ordinance being necessary_ for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
