AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR M1CROF
LEGAL SERVICES RENDERED IN CONJUNCTION WITH �11�G
THE WALTON ARTS CENTER BOND ISSUE AND
APPROVING THE PAYMENT FOR SUCH SERVICES TO THE
ROSE LAW FIPUM .
WHEREAS , the Rose Law Firm has prepared a letter ruling
request for the City of Fayetteville to the IRS regarding the
Walton Art Center , and
WHEREAS , competitive bidding was not feasible due to the Rose
Law Firms intimate and unique knowledge of the Walton Arts Center
bond issue .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
ry THE CITY OF FAYETTEVILLE , ARKANSAS :
-� Section 1 . That an exceptional situation is declared to
exist requiring the competitive bidding process to be waived , so
that competitive bidding requirements are hereby waived and the
Mayor and City Clerk are hereby authorized to approve payment for
services rendered to the Rose Law Firm in `he amount of
$ 15 , 403 . 00 .
Section 2 . That the Board of Directors hereby determines
that the City of Fayetteville is in immediate need of the legal
services provided by the Rose Law Firm in obtaining said letter
ruling and hereby determines that the immediate passage of this
ordinance is necessary in order to contract for such . Therefore ,
and emergency is hereby declared to exist and this ordinance being
necessary for the public welfare shall be in full force and effect
from and after its passage and approval .
