ORDINANCE NO. 3452
AN ORDINANCE WAIVING COMPETITIVE BIDDING
AND AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE AN AGREEMENT FOR A CENTRAL
OFFICE BASED TELECOMMUNICATIONS SYSTEM .
WHEREAS , A central office based telecommunications service is needed by
the City of Fayetteville , such service and switching equipment to be based in
the office of the company providing the service , and
WHEREAS , this service is only available from Southwestern Bell Telephone
Company .
NOW THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That ' an ' exceptional situation is declared to exist . That
competitive bidding • "should' •be and hereby is waived , and the Mayor and City
V Clerk are authorized to' . -exe61ufe agreements in the forms attached hereto as
u, Exhibits I , . II • and ' III , -by' . .and between the City of Fayetteville and
Southwestern Bell Telephone:°Company for Pease of telecommunication equipment
identified as a .. . C6ntraj',&.OfLce Base Switch System entitled Plexar II for a
term of sixty ( 60 ) Imonths at• an amount not to exceed $4 , 500 . 00 per month .
Section 2 . Emergency Clause : The Board of Directors hereby determines
that the aforesaid provisions are necessary and unless put into effect
immediately , the pybl•ic-• health , safety , and welfare of the people of
Fayetteville will be '- adversely affected . Therefore , an emergency is hereby
declared to exist and this ordinance being necessary for the public health ,
safety , 'and --welfare•—shall- be in full force and effect from and after its
passage and approval .
