AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING TO RETAIN LEGAL COUNSEL TO
REPRESENT THE CITY IN LITIGATION .
WHEREAS , James N . McCord has resigned as Fayetteville City
Attorney after more than 15 years of service ; and
WHEREAS , the Fayetteville Board of Directors desires for
James N . McCord to continue representing the City in pending
litigation and to represent the City in future litigation as
requested on a case by case basis .

V NOW THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
> THE CITY OF FAYETTEVILLE , ARKANSAS :

Section 1 . The Board of Directors hereby waives the
requirements of competitive bidding to retain legal counsel to
represent the City in litigation for the reason that said
a requirements are not feasible because selection of an attorney
LL involves subjective decision making .
Section 2 . The Board of Directors hereby retains James N .
McCord to continue representing the City in pending litigation and
to represent the City in future litigation as requested on a case
by case basis for a fee of $ 75 . 00 per hour plus expenses .
