KOLLMEYER A9V11CROFILMFD AN ORDINANCE AMENDING SECTION 21 - 26 ( b ) OF THE FAYETTEVILLE CODE OF ORDINANCES TO PRESCRIBE SEWER CHARGES FOR RESIDENTS WITHIN WEDINGTON DRIVE SEWER IMPROVEMENT DISTRICT NO . 1 OF THE CITY OF FAYETTEVILLE , ARKANSAS WHO DO NOT RECEIVE CITY WATER SERVICE . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Section 21 - 26 ( b ) of the Fayetteville Code of Ordinances is hereby amended by adding the following paragraph : The monthly residential sewer rate for residents within Wedington Sewer Improvement District No . 1 of the City of Fayetteville , Arkansas who do not receive City water service shall be : 1 to 2 member family $ 13 . 59 V 3 or more member family $ 18 . 96 Each private residential consumer shall be required to make a $ 25 . 00 service deposit with each application for sewer service . This service deposit shall be retained in trust , without interest , by the City Finance a Department . when service to the depositor is discontinued permanently , said service deposit shall be applied to the final billing and the remainder , if any , returned to the depositor . Section 2 . That the Board of Directors hereby determines that the provision of sewer service to residents within Wedington Sewer Improvement District No . 1 of the City of Fayetteville , Arkansas is essential to the public health , safety and welfare and that the immediate passage of this ordinance is necessary to provide sewer service to said residents . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
