AN ORDINANCE VACATING AND ABANDONING A PORTION MICROFILMED
OF A UTILITY EASEMENT ALONG THE SOUTH LINE OF
LOT 7 IN BLOCK 3 OF BUTTERFIELD ADDITION ,
WHEREAS , the Board of Directors has the authority under
Ark , Code Ann , § 14 - 54 - 104 vacate portions of utility easements
which are not required for corporate purposes ; and
WHEREAS , the Board of Directors has determined that the
following described portion of a utility easement along the south
line of Lot 7 in Block 3 of Butterfield Addition is not required
for corporate purposes .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 , That the City of Fayetteville , Arkansas hereby
vacates and abandons all of its rights together with the rights of
the public generally , in and to the following described utility
easement :
" That portion of a 15 foot utility easement along the
south line of Lot 7 in Block 3 of Butterfield Addition
to the City of Fayetteville , Arkansas , as per plat of
said Addition recorded in the office of the Circuit
Clerk and Ex-Officio Recorder of Washington County ,
Arkansas , embraced within and bounded by the external '
wall of an existing swimming pool as presently con-
structed on this date . " L10
