HomeMy WebLinkAboutOrdinance 3340 .� w CO 7� T rn fn 2 C) p n O f O 7-" o M1CRpF��MED r O ORDINANCE NO . 3340 v AN ORDINANCE AMENDING SECTION 17B- 11 . 2 OF THE FAYETTEVILLE CODE OF ORDINANCES TO PROVIDE THAT THE BOARD OF ADJUSTMENT SHALL CONSTITUTE A BOARD OF SIGN APPEALS . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Section 17B- 11 . 2 ( a ) of the Fayetteville Code of Ordinances is hereby amended to read as follows : Sec . 17B- 11 . 2 Board of Sign Appeals . ( a ) Created . The Board of Adjustment established by Article 10 of Appendix A to the Fayetteville Code of Ordinances shall , by virtue of their office , constitute a Board of Sign Appeals . The word " board" when used in this section shall be con- strued to mean the Board of Sign Appeals . Section 2 , That Section 17B- 11 . 2 ( e ) of the Fayetteville Code of Ordinances is hereby amended to read as follows : ( e ) Appeals from Board of Sign Appeals . Any member of the Board of Directors may appeal the decision of the Board of Sign Appeals to the Board of Directors by filing written notice of appeal with the City Clerk within 10 days from the date of such decision . The notice of appeal shall specifically state the reasons the appel - lant contends the findings and decision of the Board of Sign Appeals were in error . The Board of Directors shall hear the appeal only if a majority of the full board vote in favor of a hearing . If the Board of Directors votes to hear an appeal , the Board shall hear all persons desiring to be heard on the question of whether the findings and decision of the Board of Sign Appeals were in error . Following such hearing , the Board of Directors may affirm , modify , or reverse any finding and decision of the Board of Sign Appeals or may refer the matter back to the Board of Sign Appeals for additional findings . That the Board of Directors hereby determines that efficient administration and enforcement of the sign ordi - nance is essential to the public welfare and hereby determines that the immediate passage of this ordinance is necessary for efficient enforcement and administration of the sign ordinance . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public welfare shall be in full force and effect from and after its passage and approval .
