AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING TO RETAIN OUTSIDE COUNSEL
FOR CONSULTATION ON CABLE FRANCHISE RENEWAL ,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
3\ Section 1 . That the Board of Directors hereby waives the
I requirements of competitive bidding to retain outside counsel for
consultation on cable television franchise renewal for the reason
that said requirements are not feasible because selection of legal
counsel involves subjective decision making .
Section 2 . That the Board of Directors hereby authorizes
the retention of Arnold & Porter , Attorneys at Law , Washington ,
D . C . for consultation on cable franchise renewal at a fee not to
exceed $ 2 , 500 . 00 .
Section 3 . That the Board of Directors hereby determines
that a new comprehensive cable television franchise is essential
to the public welfare , hereby determines that the immediate
assistance of expert outside legal counsel is necessary to develop
such a franchise , and hereby determines that the immediate passage
of this ordinance is necessary to develop such a franchise .
Therefore , an emergency is hereby declared to exist and this
ordinance being necessary for the public welfare shall be in full
force and effect from and after its passage and approval .
