SECTION I OF THE FAYETTEVILLE CODE OF ORDINANCES TO AMEND THE CITY ' S REGULATIONS FOR NOTICE AND APPROVAL OF LARGE SCALE DEVELOPMENT PLANS , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Appendix C . Section I ( 1 ) of the Fayette- ville Code of Ordinances is hereby amended by amending the first paragraph to read as follows : ( 1 ) All large scale developments , not hereinafter excluded , must be reviewed by the Plat Review Committee and the Subdivision Committee and must be approved by the Planning Commission ; after having afforded the oppor - tunity for public comment , before a building permit may be issued . Approval by the Board of Directors shall not be required unless an appeal is taken and heard pursuant to paragraph ( 6 ) of this section . Section 2 . That Appendix C . Section I ( 2 ) ( e ) of the Fayetteville Code of Ordinances is hereby amended by substituting the term " Planning Commission" for the term " Subdivision Com- mittee " in the first sentence and by adding subparagraph ( 4 ) to read as follows : ( 4 ) Proof of notice pursuant to subparagraphs 1 , 2 , or 3 above shall be filed with the Planning Administrator at least seven ( 7 ) days prior to the Subdivision Committee meeting at which approval of the large scale development plan will be considered . The notice shall specify the date of the Subdivision Committee meeting and the date of the Planning Commission meeting at which the large scale development plan will be considered . Section 3 . That Appendix C , Section I ( 6 ) of the Fayette- ville Code of Ordinances is hereby amended to read : ( 6 ) The developer , or the owners of any property adjacent to the proposed large scale development , or any member of the Board of Directors , may appeal the decision of the Planning Commission to the Board of Directors by filing written notice of appeal with the City Clerk within ten ( 10 ) days from the date of such decision . The notice of LIBER 1258PAGE877 .� ' _, - 2 - appeal shall specifically state the reasons the appel- lant contends the Planning Commission ' s findings and decision were in error . An appeal may be heard by the Board of Directors only if a majority of the Board votes to hear the appeal . Section 4 . The Board of Directors hereby determines effective regulation of large scale developments in the City is essential to the public health , safety and welfare and hereby determines that the immediate passage of this ordinance is necessary for effective regulation of large scale developments . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
