BE TT ORDAINED By THE BOARD OF DIRECTORS OF THE CITY OF FAYErTEVILLE, ARKANSAS: Section 1 . That the Board of Directors hereby waives the requirements of competitive bidding for the purchase of traffic signal equipment for the reason that said requirements are not feasible as there is only one supplier who can provide new traffic signal equipment compatible with existing equipment . Section 2 . That the Board of Directors hereby authorizes the purchase of traffic controllers , cabinets , and base coordination units from Pinkley Sales Co . in accordance with the proposal attached hereto, marked Exhibit "A" and made a part hereof . Section 3 . That the Board of Directors hereby determines that the immediate purchase of additional traffic signal equipment is necessary for vehicular and pedestrian safety . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
