Home My WebLink AboutOrdinance 3159 FI L ED FGR RECORD °�e FFe n " ' �'%; 10 MICK)FILMED ACd+� 000GUI' ryAR ORDINANCE ND, 3159 ' CIRCUIT OAIEY R AN ORDINANCE ANNEXING CERTAIN PROPERTY TO CENTRAL BUSINESS IMPROVEMENT DISTRICT NO, 1 OF THE CITY OF FAYETIEVILLE , ARKANSAS . tiWHEREAS, persons claiming to be the owners of two_thirds of assessed v value , as shown by the last County assessment , of real property contiguous to Central Business Improvement District No . 1 of Fayetteville , Arkansas have petitioned to have said property annexed to said Improvement District ; and CJ WHEREAS , following publication of notice as required by law , p, the Fayetteville Board of Directors has held a Public Hearing on the question of whether two-thirds in assessed value of the owners of real property in the territory sought to be annexed have signed such petition ; and WHEREAS, the Fayetteville Board of Directors has determined that said petition contains the requisite signatures . NOW, 1HU&FORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, AMMEAS= Section 1 . That the following described real property is hereby annexed to Central Business Improvement District No . 1 of Fayette- ville , Arkansas : Lots 1 , and 2 , and ten ( 10 ) feet of and uniform width off the North side of Lot 3 ; all of Lots 13 , 14 , and 15 , all in Block 26 of the original plat of the Town (now City ) of Fayetteville , Arkansas as per plat recorded in the office of the Circuit Clerk and Ex- Officio Recorder of Washington County , Arkansas . Section 2 . The Board of Directors hereby determines that Central Business Improvement District No . 1 was established to promote redevelopment of the downtown square area by making tax exempt financing available to potential developers , that the area proposed for annexation is contiguous to the Central Business Improvement District , that Congress has under consideration proposed legislation which would prohibit the use of tax exempt financing for private redevelopment projects after January 1 , 1986 and that redevelopment of the area proposed for annexation will promote the public welfare . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public welfare shall be in full force and effect from and after its passage and approval .
