S AN ORDINANCE AMENDING ARTICLE 7 OF APPE[VOfr{ C ,FYF 4R TO THE FAYETTEVILLE CODE OF ORDINANCES BY ADDINtFRK R SECTION 24 TO AUTHORIZE ACCESSORY RESIDENTIAL USES IN NON-RESIDENTIAL DISTRICTS . BE TT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYET EWLIE, ARKANSAS: Section 1 . That Article 7 of Appendix A to the Fayetteville Code of Ordinances is hereby amended by adding Section 24 , Accessory Residential Uses in Non-Residential Districts , to read as follows : 24 . Accessory Residential Uses in Non-Residential Districts ( a ) Attached residential uses shall be permitted in the C-1 , C-2 , I-1 , and I-2 zoning districts as a use by right . Density limitations and off -street parking space requirements for attached residential uses in such zoning districts shall be governed by paragraphs ( A) and ( C ) of Article 6 , Section IX . ( b ) A detached residential dwelling unit may be permitted in the C-1 , C-2 , I-1 , and I-2 zoning districts as a conditional use . Density limitations and off-street parking space requirements shall be governed by paragraphs ( A ) and (C ) of Article 6 , Section IX . The building site and yard area nust be separate and distinct from off-street parking spaces and set-back areas required for the principal structure and shall include a minimum of 4 , 200 square feet of land area . The residential structure shall be located to meet required set-backs frau exterior boundaries of the total tract . The property owner shall execute and record a covenant providing that the residential structure shall not be sold separate from the principal structure ; the covenant shall run with the land .
