Section 1. That the Board of Directors hereby vacates and
abandons the western most 10 feet of the platted utility easement
across the east side of Lot 19 in Summerhill, a planned unit development.
Section 2. The Board of Directors hereby determines that
the immediate passage of this ordinance is necessary for the public
welfare. Therefore, an emergency is hereby declared to exist, and
this ordinance shall be effective from and after its passage and approval.

BE IT KNOWN BY THESE PRESENTS that Southwestern Bell
Telephone Company hereby concurs in the closing of the following
easement in Fayetteville, Arkansas, to -wit:
The Western 10' of a parcel 25' wide and 150'
long, the Eastern boundary of which is also
the Eastern Boundary line of Lot 19 Summerhill
Subdivision to the City of Fayetteville,
Arkansas, as per plat on file in the office of
the Circuit Clerk and EX-Officio Recorder for
Washington County, Arkansas,
Southwestern Bell Telephone Company does not have any
facilities in this easement nor do they plan to place any in the
future.

DISTRICT MANAGER-INSTALLATION/MAINTENANCE - Fort Smith
Enclosed you will find a letter from Mr. Bill Meadows
requesting the relinquishment of the western ten feet of a
twenty-five foot easement on his east property line. This
easement runs north and south along lot 19 of Summerhill
Subdivision in the North part of the Fayetteville Exchange.
(Shown in red on the enclosed plat.)
Southwestern Bell does have cable in this easement,
but it lies eight (8) feet off of the eastern easement line.
I feel; therefore, that a fifteen foot easement is acceptably
sufficient and recommend Mr. Meadow's request.

I would like to construct a swimming pool in my back
yard at 1470 Langston Place, Summerhill Subdivision, in
Fayetteville. As the utility easement is 25 feet off the
east boundary of the property, however, there is not
sufficient space to position the pool. All the utility
companies have spotted their underground service and
none is beyond a point twelve feet from the east line.
Please find enclosed a legal description and plot of the
property.
My request is that the easement be reduced to 15
feet from the east line. If this is not a problem for you,
I would appreciate your sending me a letter to that effect.
