ARKANSAS: Section 1 . That Article III , §A( 1 ) ( k ) ( 5 ) of Appendix C to the Fayetteville Code of Ordinances is hereby amended by amending the first paragraph to read as follows : ( 5 ) Upon recommendation of the Planning Commission , after consultation by the Commission with the Parks and Recreation Advisory Board , the Board of Directors , upon determination that enforcement of the ordinance would cause unnecessary hardship or that the problems or merits of the development reflect unique circumstances , may waive or vary the requirements of this section , provided : Section 2 .
