AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE
BIDDING FOR THE PURCHASE OF LIQUID OXYGEN FOR
THE POLLUTION CONTROL PLANT ,
BE IT ORDAINED BY THE BOARD OF DIRECPORS OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That the Board of Directors hereby waives the
requirements of competitive bidding for the purchase of liquid oxygen
for the Pollution Control Plant for the reason that said requirements
are not practical because upcoming expansion of said Plant will require
that facilities placed by the current supplier be relocated ,
Section 2 . The Board of Directors hereby authorizes the purchase
of liquid oxygen for the Pollution Control Plant from Union Carbide
Linde Division for one year beginning March 1 , 1985 , at a price
of $ . 77 per one hundred cubic feet .
Section 3 . The Board of Directors hereby determines that
the City ' s Pollution Control Plant is in need of an uninterrupted
supply of liquid oxygen for efficient operation ; that efficient operation
of the Pollution Control Plant is essential to the public health and
welfare ; and that the immediate passage of this ordinance is necessary
for the efficient operation of the Pollution Control Plant , Therefore ,
an emergency is hereby declared to exist and this ordinance being
necessary for the public health and welfare shall be in full force
and effect from and after its passage and approval .
