Home My WebLink AboutOrdinance 3045 tDR Up�D JFK 3045 mDWICE NDS Cj\ ` MICROFR A ib AN ORDINANCE CREATING THE FAYETTEVILLE ARTS CENTER BOARD; PRESCRIBING THE TERMS FOR ARTS CENTER BOARD MEMBERS AND THE METHOD OF FILLING VACANCIES ON THE ARTS CENTER BOARD ; AND, PRESCRIBING THE RESPONSI- BILITIES OF THE ARTS CENTER BOARD, BE IT ORDAINED BY THE BOARD OF DIIWIO tS OF THE CITY OF FAYETIWILLE, ARRANSAS: 1+ Section 1 . There is hereby created the Fayetteville Arts `.D Center Board to be composed of seven ( 7 ) members who shall be citizens of the City of Fayetteville and qualified electors of the municipality . Arts Center Board members shall be appointed by a majority vote of V the Board of Directors . The initial members of the Arts Center Board shall serve staggered terms to be designated by the Board of Directors . Upon expiration of the initial Arts Center Board members ' respective terms , successor Arts Center Board members shall each be appointed to a term of 3 years . The Board of Directors may remove an Arts Center Board member by a two-thirds vote of the full Board . Vacancies on the Arts Center Board shall be filled by majority vote of the Board of Directors . iy. Section 2 . The Arts Center Board shall prepare a recommendation to the Board of Directors regarding : ( a ) The location of an Arts Center ; ( b ) Financing the construction , or renovation , and operation of an Arts Center ; ( c ) Allocating the use of an Arts Center to best serve the overall needs of the community ; and (d ) Use of the Arts Center by the University of Arkansas . To assist the Arts Center Board in preparing said recommendation , the Arts Center Board may contract with such persons as it deems necessary ; provided , no such contract shall be executed without the approval of the Board of Directors . Section 3 . Upon completion of the Fayetteville Arts Center ( the ' Center ' ) , the Arts Center Board shall have the authority and responsibility to : ( a ) Manage , operate and maintain the Center ; ( b ) ploy such managers , janitors , and other employees as are necessary for the proper management , operation and maintenance of the Center and to fix the salaries of said employees ; ( c ) To purchase all supplies , equipment and other property necessary for the management , operation and maintenance of the Center ; provided , all purchases in excess of $2 , 500 . 00 shall be made after advertised , competitive bids and shall be awarded to the lowest responsible bidder ; (d ) Contract with persons , firms , corporations or organizations for the use of the Center ; ( e ) Adopt , and amend , rules and regulations for the use , operation and management of the Center ; provided , said rules and regula- tions shall be subject to approval by the Board of Directors ; ( f ) Impose and collect fees for the use of the Center ; provided the amount of said fees shall be approved by the Board of Di rectors . elov, -U24 P1.1A01 Section 4 , The Arts Center Board shall submit to the Board of Directors an annual financial report reflecting the revenues and expenses of the Center and shall submit such other reports as are requested by the Board of Directors . Section 5 . All fees received by the Arts Center Board for use of the auditorium shall be deposited in a separate fund to be designated the "Fayetteville Arts Center Fund" and shall be used exclu- sively for the operation , maintenance , or improvement of the Center . The Arts Center Board may accept donations for the Center and shall deposit all donations in the aforesaid fund . Section 6 . Arts Center Board members shall receive no compensation but shall be reimbursed for actual expenses incurred in fulfilling their responsibilities . Section 7 . The Arts Center Board shall not have the authority to sell , mortgage or encumber the Center . Section 8 . The Board of Directors may appropriate funds to be deposited in the Auditorium Fund for use by the Arts Center Board in operating , maintaining and improving the Center .
