BE IT ORDAINED BY THE BOARD OF DIRECTORS� OF � THE'_ ,OlgY OF FAYETTEVILLE , ARKANSAS : Section 1 : That the Board of Directors hereby waives the requi er m nene t of competitive bidding for the purchase of concrete aggregate asphalt and the other materials described in Exhibit "A" hereto because said requirements are not practical as there is only one area supplier of the products needed by the City . Section 2 : The Board of Directors hereby authorizes 77� the purc�e,on an as needed basis , from McClinton-Anchor Company , Division of APCA-Arkansas , Inc . of the materials set out in Exhibit "A" attached hereto and made a part hereof , at the prices reflected in said Exhibit "A" . Section 3 : The Board of Directors hereby determines that the City of Fayetteville is in immediate need of the products set out in Exhibit "A " hereto in order to construct improvements essential to the public health , safety and welfare . Therefore , an emergency is hereby declared to exist and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage and approval .
