AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE
BIDDING FOR THE PURCHASE AND INSTALLATION OF POLES ,
TIMERS AND HARD14ARF. FOR A NOISE BARRIER AT DRAKE
FIELD .

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the Board of Directors hereby waives
the requirements of competitive bidding for the purchase and
installation of poles , timbers , and hardware for the construc -
tion of a noise barrier at Drake Field because said requirements
are not feasible as there is an immediate need for a noise
barrier at Drake Field to safeguard the public welfare .
Section 2 . The Board of Directors hereby determines
that stat ovary aircraft engine testing at Drake Field is
creating a public disturbance and potential liability to the
City for monetary damages ; that the immediate construction of
a noise barrier at Drake Field is necessary to safeguard the
public welfare ; and that the immediate passage of this
ordinance is necessary to facilitate construction of a noise
barrier at Drake Field . Therefore , this ordinance being
necessary for the public welfare shall be in full force and
effect from and after its passage and approval .
PASSED AND APPROVED this 20th day of September 1983 .
