APPROVE A BILL OF ASSURANCE EXECUTED BY A PROPERTY w
OWNER TO GUARANTEE INSTALLATION OF A REQUIRED lDEWALV�
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF HTE `.CITY DF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Sec . 18 - 31 ( a) of the FayettgvAIje g o �r
Code o Or finances is hereby amended by amending SIA s econ4- o
sentence in said section to read as follows : � -<

c ' Said notice shall be issued at the time a building Ln
permit for the property is issued ; provided , in lieu
of issuing said notice at said time , the City Manager
may accept a bill of assurance executed by the property
owner to guarantee installation of the sidewalk within
three months from receipt of notice from the City
Manager ; the property owner ' s obligation under the
bill of assurance shall be a covenant running with
the land , and the form of the bill of assurance shall
be approved by the City Attorney .
Section 2 . The Board of Directors hereby determines that
the or er y construction of sidewalks is essential to the
public health , safety and welfare ; and hereby determines that
the immediate passage of this ordinance is necessary to provide
for the orderly construction of sidewalks . Therefore , an
emergency is hereby declared to exist and this ordinance being
necessary for the public health , safety and welfare shall be
in full force and effect from and after its passage and approval .
