HomeMy WebLinkAboutOrdinance 2897 ORDINANCE NO . z:2 8 Y 7 s i V ti `v Cn C ' AN ORDINANCE AUTHORIZING AND DIRECTING THE S ITS MANOR TO ABATE UNSIGHTLY , UNSANITARY AND UNSAFE (MNbI-TIONS o EXISTING ON CERTAIN PROPERTY LOCATED ON BL&IR.� STREEFJD� T AND OWNED BY REX DAVIS . ~ r C' M o C WHEREAS , Rex Davis is the owner of the rear' t�rppert� C described in Exhibit "A" attached hereto and macre parto 0 hereof ; and 2 � , WHEREAS , the aforesaid property is unsightly , unsafe , unsanitary and detrimental to the public health safety , and welfare ; and WHEREAS , the owner of the aforesaid property , after having been given well over 20 days notice to do so , has neglected and refused to remove , abate , or otherwise eliminated the unsightly , unsafe , unsanitary conditions existing on the aforesaid properties . NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That under the authority of Ark . Stats . 19 - 2803 , 19 - 2325 - 19 - 2328 , Section 11 - 1 - 11 - 3 0£ the Fayetteville Code of Ordinances , the City Manager , or his duly authorized representative , is hereby authorized and directed to raze , remove , and do whatever is necessary to correct the unsightly , unsanitary , and unsafe conditions and building existing on the aforedescribed property . Section 2 . That the City Manager is hereby authorized and directed to charge the cost of correcting said conditions to the owner of said property ; and under the authority of Ark . Stat . 19 - 2326 and Section 11 - 3 of the Fayetteville Code of Ordinances , the City of Fayetteville shall have a lien against the aforesaid property for such costs . Section 3 . That the City Attorney is hereby authorized to enforce the aforesaid liens within 18 months after work has been done by action in the Washington County Chancery Court . Section 4 . The Board of Directors hereby determines that the conditions existing on the aforesaid property are unsightly , unsanitary , dilapidated , unsafe , and detrimental to the public health , and further determines that unless the provisions of this ordinance are put into effect immediately , the public health , safety and welfare of the people of = 107? 995 - 2 - Fayetteville will be adversely affected . Therefore , an emergency is hereby declared to exist , and this ordinance being necessary for the public health , safety and welfare shall be in full force and effect from and after its passage .
