AN ORDINANCE AMENDING SECTION 13 - 8 . 1 ( c) OF TH CIRCUIT CLERK
FAYETTEVILLE CODE OF ORDINANCES TO PROVIDE THAT
THE SOUND LEVEL LIMITS PRESCRIBED BY SAID SECTION
SHALL APPLY TO NOISE ORIGINATING ON PUBLIC PROPERTY
AS WELL AS PRIVATE PROPERTY .
BE IT ORDAINED BY THE BOARD OF DIRECTIONS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the first paragraph in Section 13 - 8 . 1 ( c )
of the Fayetteville Code of Ordinances is hereby amended to
read as follows :
( c) Limitations by Land Use Category . No
person shall operate or cause to be operated on
public or private property any source of sound in
such a manner as to create a sound level which
exceeds the limits set for the receiving land use
Ci category in Table I below when measured at or within
the property boundary of the receiving land use .
Section 2 . The Board of Directors hereby determines
that epi e noise regulation is essential to the public
welfare and that the immediate passage of this ordinance is
necessary for effective noise regulation . Therefore , an
emergency is hereby declared to exist and this ordinance
being necessary for the public welfare shall be in full
force and effect from and after its passage and approval .
