AN ORDINANCE AMENDING ARTICLE VI OF ORDIN LKOLLMEYER
2677 REGULATING THE DISCHARGE OF WATERS AND P(� UIT CLERK
INTO THE PUBLIC SEWER SYSTEM TO PROVIDE THAT UPON
PROMULGATION OF FEDERAL CATEGORICAL PRETREATMENT
STANDARDS FOR A PARTICULAR INDUSTRIAL CATEGORY SAID
FEDERAL STANDARD , IF MORE STRINGENT THAN LOCAL
STANDARDS , SHALL APPLY .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Article VI of Ordinance No . 2677 is
hereby am�U by adding Section 10 to read as follows :
C Section 10 . Upon the promulgation of federal
categori'c'al—p7retreatment standards for a particular
industrial subcategory , the federal standard , if more
stringent than the City ' s limitations for sources in
that subcategory , shall apply . The superintendent
shall notify all affected users of the applicable
reporting requirements under 40 CFR , § 403 . 12 .
Section 2 . This ordinance shall be codified as Section
21 - 95T6`T_T Fayetteville Code of Ordinances .
Section 3 . The Board of Directors hereby determines
that EtTe'City s sewer regulations should be clarified to
enable effective operation of the City ' s sewage treatment
plan ; that such operation is essential to the public welfare ;
and that the passage of this ordinance is necessary to enable
such operation . Therefore , an emergency is hereby declared to
exist and this ordinance being necessary for the public wel -
fare should be in full force and effect from and after its
passage and approval .
