AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF'DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That Article III of Chapter 19 of the
Fayetteville Code of Ordinances is hereby amended by adding
Section 19-100 to read as follows:
Sec. 19-100. Spilling loads on highways
prohibited,
(a) No vehicle shall be driven or moved on
any street or highway unless such vehicle is so
constructed or loaded as to prevent any of its
load from dropping, sifting, leaking, or otherwise
escaping therefrom; provided sand may be dropped
for the purpose of securing traction, or water or
other substances may be sprinkled on a street or
highway for cleaning or maintenance purposes.
(b) Any person convicted of violating Section
(a) above shall be punished by a fine of not more
,than $500.00 or double that sum for each repetition
of such offense,,
Section.2;!,,The Board-'ofDirectors hereby determines
that vehicles,such as gravel trucks and similar vehicles
which spill�a portion of >their;load onto the streets and
highways create a publicsafetyhazard; and that the immediate
passage of this' ordinance is necessary to prevent such
spilling.. Therefore, an emergency is hereby declared to
exist and this ordinance being necessary for the public
safety and welfare shall be in full force and effect from
and after its passage and approval.
