AN ORDINANCE AUTHORIZING ABATEMENT PROCEEDINGS FOR��`•' `

WHEREAS , Bill H . Hawkins and Francis K . Hawkins are
the owners of the real property located at 1899 Custer Lane
and more particularly described as Lot No . 5 in Block No .
2 of Red Arrow Subdivision No . 2 in the City of Fayetteville ,
Arkansas ; and ,
WHEREAS , the Board of Directors has determined that
the house located on said property is dilapidated , unsitely ,
unsafe , irrepairable and detrimental to the public welfare ;
and ,
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That Bill H . Hawkins and Francis K . Hawkins
are heresy ordered to raze and remove the dilapidated ,
unsitely , unsafe , and irrepairable house located on the
following described property within thirty days from the
�l effective date of this ordinance :
r Lot No . 5 in Block No . 2 of Red Arrow No . 2 Subdivision
v to the City of Fayetteville , Arkansas , as per plat of
said subdivision on file in the office of the Circuit
Clerk and Ex Officio Recorder of Washington County ,
Arkansas .
Section 2 . That the City Attorney is hereby directed
to institute such legal proceedings as may be necessary in
order to enforce the provisions of this ordinance , and to
remedy the dangerous and unsitely conditions existing on
the aforesaid property . Said legal proceedings shall provide
that unless the house is razed within a certain period specified
by the court , the City of Fayetteville shall be authorized
to raze said house and have a lien upon the real estate for
the cost of razing and removing the house .
Section 3 . The Board of Directors hereby determines
that tH—e-Tforesaid unsitely and unsafe house constitutes
a continuing detriment to the public welfare and determines
that unless the provisions of this ordinance are put into
effect immediately , the public health , ' safety and welfare
of the people of Fayetteville will be adversely affected .
Therefore , an emergency is hereby declared to exist and this
ordinance being necessary for the public welfare shall be
in full force and effect from and after its passage and
approval .
