AN ORDINANCE AMENDING ORDINANCE NO . 2695 , AS
AMENDED BY ORDINANCE NO . 2698 , TO CLARIFY THAT 1%,,1F�'(r',
THE PUBLIC PARK REQUIREMENTS` IMPOSED THEREBY ON /
SUBDIVIDERS APPLY TO SUBDIVISIONS OUTSIDE THE
CITY ' S CORPORATE LIMITS BUT WITHIN THE CITY ' S
DESIGNATED EXTRA- TERRITORIAL PLANNING AREA .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Section 1 of Ordinance No . 2695 is
hereby amended by amending the first sentence to read as
follows :
Section 1 . That Article III , Section A ( 1 ) of Appendix
C to the Fayetteville Code of Ordinances is hereby
amended by adding paragraph (k) to read as follows :
J Section 2 . That the first sentence in Section 2 of
Ordinance No . 2698 is hereby amended to read as follows :
Section 2 . That Article III , Section A ( 1 ) of Paragraph
(k) (3 ) of Appendix C to the Fayetteville Code of Ordinances
is hereby amended by adding the following :
Section 3 . That Article III , Section A ( 2 ) of Appendix
C to tt ei�teville Code of Ordinances is hereby amended
by adding Paragraph ( i ) to read as follows :
( i ) Required dedication of land for public
park sites , or a reasonable equivalent contribution
in lieu of dedication of land . The subdivider shall
comply with the provisions of Section A ( 1 ) (k) of this
article .
Section 4 . The Board of Directors hereby determines
that t e1� i y s subdivision regulations do not make adequate
provision for park sites and park facilities ; that adequate
provision for park sites and park facilities when land is
subdivided and developed is essential to the public welfare ;
and that the passage of this ordinance is necessary to make
adequate provision for park sites and park facilities .
Therefore , an emergency is hereby declared to exist and this
ordinance being necessary for the public health , safety and
welfare shall be in full force and effect from and after
its passage and approval .
