AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 10 /f?�U/T I £ Y rAR, OF THE FAYETTEVILLE CODE OF ORDINANCES TO INCREASE e�� 4Ff COLLECTION CHARGES FOR SANITATION SERVICES . \ BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF U FAYETTEVILLE , ARKANSAS : j Section 1 . That Sec . 10 - 28 of the Fayetteville Code of Or ina�is hereby amended to increase the monthly residential rate for sanitation services prescribed thereby from $4 . 60 per month for two cans to $ 5 . 00 per month for two cans and to increase from 40 cents per month to 44 cents per month the rate for each additional can . Section 2 . That Sec . 10 - 29 of the Fayetteville Code of Or ina� nces is hereby amended by increasing the minimum monthly commercial rate for sanitation services prescribed thereby from $ 4 . 60 per month for one can to $ 5 . 00 per month for one can and to increase the monthly rate for each additional can prescribed thereby from 40 cents per additional can to 44 cents per additional can . Section 3 . That Sec . 10 - 29 . 1 of the Fayetteville Code of Or inad nces is hereby amended by increasing the rate for any commercial establishment using load - all type containers for the collection of garbage from $ 1 . 65 per cubic yard per pick-up to $ 1 . 82 per cubic yard per pick-up . Section 4 . That Sec . 10 - 29 . 2 of the Fayetteville Code of Or ina�is hereby repealed . Section 5 . The Board of Directors hereby determines that the City ' s existing sanitation rates are not sufficient to provide adequate sanitation service ; that provision of adequate sanitation service is essential to the public welfare ; and that the passage of this ordinance is necessary to provide essential sanitation service . Therefore an emergency is hereby declared to exist and this ordinance being necessary for the public welfare shall be in full force and effect from and after its passage and approval .
