ARN AN ORDINANCE LOWERING THE FRANCHISE TAROZE46A K$rY SOUTHWESTERN ELECTRIC POWER COMPANY . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That the first paragraph after the last "Whereas se of the street rental contract between Southwestern Electric Power Company and the City of Fayetteville , dated December 29 , 1944 , as amended by Resolution No . 4 - 68 and Ordinance No . 2237 , is hereby amended to read as follows : Southwestern Electric Power Company ( successor to Southwestern Gas and Electric Company) agrees to pay to the City a sum equal to three percent ( 3%) of the company ' s gross revenues derived from the sale of electric power and energy to domestic and commercial customers within the city limits of the City of Fayetteville and one percent ( 1%) of the company ' s gross revenues derived from the sale of electric power and energy to industrial consumers within the City limits of the City of Fayetteville . Said sum is to be due and payable quarterly , and the company shall have thirty (30 ) days after the expiration of each quarter in which to make said payment . Section 2 . That this ordinance shall be effective thirty (3Qay3 s air the date of publication by the Washington County Court of the proclamation declaring the results of the election on a county sales tax held July 28 , 1981 ; provided , in the event of an election challenge the effective date of this ordinance shall be the first day of the first calendar month subsequent to the final judicial determination of the challenge .
