AN ORDINANCE AMENDING SECTION 9 - 6 OF THE FAW TTEVILLE

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE , ARKANSAS :
Section 1 . That Sec . 9 - 6 of the Fayetteville Code of
Ordinances is hereby amended by replacing the period at the
end of sub - paragraph ( e ) with an apostrophe and by adding
the following :
or , ( 3 ) a written contract executed by the owner or
occupant of a residential dwelling or non- residential
building located not more than - 2 miles beyond the City ' s
corporate limits , which contract shall contain the following
provisions :
( a ) The owner or occupant of a residential dwelling
shall pay to the City in advance an annual standby
fire protection fee equivalent to $ 190 . 00 per
household , with the fee for subsequent years
determined annually .
J ( b ) The owner or occupant of a non- residential
t structure shall pay to the City in advance an
annual standby fire protection fee equivalent to
the larger of the following :
( 1 ) $ 200 . 00 , or
( 2 ) Fair market value of property ( as
determined by the City Manager or his
authorized representative ) times . 1 % fire
rating as determined by Fayetteville Fire
Chief or his authorized representative =
yearly fee .
( c ) The contract for property located within the
corporate limits of an incorporated town or city
shall not be executed without the prior approval
of the governing body of said incorporated town
or city .
( d ) No contract shall be executed without the
prior determination by the Fayetteville Fire Chief
or his authorized representative that the property
covered by the contract can be identified and
protected by the Fayetteville Fire Department ;

( e ) For each fire combated by the Fayetteville
Fire Department , the property owner shall pay a
fee of $ 250 . 00 for the first hour during which
Fayetteville firemen are at the fire site plus
$ 100 . 00 for each additional hour or fractional
part thereof that Fayetteville firemen are at the
site ;
or , ( 4 ) To protect human life which is , or appears to be ,
in jeopardy , regardless of whether there is a contract
for fire protection . However , once the Fire Department
has rescued the lives in jeopardy , or has determined
that no lives are in jeopardy , the firefighters will
take no further steps to protect against the loss of
property but will immediately leave .
Section 2 . The Board of Directors hereby determines
that t ei� providing of efficient fire protection to local
residents is essential to the public health , safety and welfare
and determines that the passage of this ordinance is necessary
to insure adequate and efficient provision of fire protection
services to local residents . Therefore , an emergency is
hereby declared to exist and this ordinance being necessary
for the public health , safety and welfare shall be in full
force and effect from and after its passage and approval .
