FAYETTEVILLE CODE OF ORDINANCES TO AUTHORIZE, THE CCfR{{
BOARD OF DIRECTORS TO WAIVE OR VARY THE RIGHT - OF -WAY
DEDICATION REQUIREMENT IMPOSED THEREBY .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Sec . 18 - 47 ( 3 ) (a ) of the Fayetteville
Code oo Ounces is hereby amended by adding the following :
; provided , the Board of Directors may waive or vary
the right - of -way dedication requirement imposed hereby
in the event of undue hardship .
Section 2 . That Sec . 18 - 47 ( 3 ) of the Fayetteville Code
of Or ina�is hereby redesignated Article IV , Section ( J )
of Appendix C to the Fayetteville Code of Ordinances .
Section 3 . That Appendix C to the Fayetteville Code of
Ordinances is hereby amended by amending the title of said
Appendix to read as follows :
Appendix C
Regulations Controlling the Development of Land
Section 4 . All ordinances or parts thereof in conflict
herewith are hereby repealed .
Section 5 . The Board of Directors hereby determines that
Sec . I$�+5Z3rof the Fayetteville Code of Ordinances does not
effectively regulate land development ; that effective regulation
of land development is essential to the public health , safety
and welfare ; and that the passage of this ordinance is necessary
to effectively regulate land development . Therefore , an emergency
is hereby declared to exist and this ordinance being necessary
for the public health , safety and welfare shall be in full force
and effect from and after its passage and approval .
