AN ORDINANCE AMENDING ARTICLE III OF CHAPTERI'Z� LTJ
THE FAYETTEVILLE CODE OF ORDINANCES TO ADOPT THL+�p/�Fh �F/f
1979 EDITION OF THE SOUTHERN STANDARD BUILDING
CODE AND TO PRESCRIBE CERTAIN AMENDMENTS THERETO .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 , That Section 6 - 34 ( a ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
(a ) There is hereby adopted by the Board of Directors
of the City of Fayetteville , Arkansas , by reference
thereto the provisions set forth in the 1979 edition
of the Southern Standard Building Code including
appendices A through K , save and except such portions
of said code as may be deleted , modified , or amended ;
and the provisions contained in said Southern Standard
Building Code are hereby adopted and incorporated as
fully as if set out in length herein , and the provisions
thereof shall be controlling within the corporate limits
of the City of Fayetteville , Arkansas .
Section 2 . That Section 6 - 47 ( a ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
( a )_ On all buildings , structures or alterations requiring
a building permit , as set forth in Section 105 of the
Building Code adopted by Section 6 - 34 , a fee shall be paid
as required at the time of filing applications , in accordance
with Appendix K , Sec . ( a ) of the Building Code , as amended .
Section 3 , That Section 6 - 48 of the Fayetteville Code
of Ordinances is hereby amended to read as follows :
For the moving of any building or structure , the fee
shall be as set forth in Appendix K , paragraph ( b ) of
the Building Code , as amended .
Section 4 . That Section 6 - 49 of the Fayetteville Code of
Ordinances is hereby amended to read as follows :
For the demolition of any building or structure , the
fee shall be as set forth in Appendix K , paragraph ( c )
of the Building Code , as amended , except that no permit
shall be required to demolish residential buildings ,
residential garages , or residential storage buildings .
Section 5 . That the Fayetteville Code of Ordinances is
hereby amended by adding Section 6 - 65 to read as follows :
Sec . 6 - 65 , Section 103 . 6 amended .
Section 103 . 6 of the Building Code is hereby amended by
adding the following paragraph :
A 1/2 " tolerance shall be allowed from any
dimension specified by the Building Code .
Section 6 . That the Fayetteville Code of Ordinances is
hereby amended by adding Section 6 - 65 . 1 to read as follows :

Section 7 . That the Fayetteville Code of Ordinances is

Section 107 . 1 of the Building Code is hereby amended
by adding the following paragraph :
In addition to the Building Permit fee , a cash
performance bond in the amount of $ 50 . 00 shall be deposited
with the Building Official to guarantee that the building ,
or addition , is not occupied before a Certificate of
Occupancy is issued . Said performance bond shall be
forfeited if the building , or addition , is occupied
prior to issuance of a Certificate of Occupancy ; otherwise ,
it shall be refunded .
Section 8 . That Sections 6 - 70 , 6 - 80 , and 6 - 81 of the
Fayetteville Code of ordinances are hereby deleted .
Section 9 . That the heading and the first paragraph in
Section 6 - 77 of the Fayetteville Code of Ordinances are hereby
amended to read as follows :
Sec . 6 - 77 . Section 304 ( 11 ) through ( 14 ) added .
Paragraphs (11 )_ through ( 14 ) are hereby added to Sec . 304
of the Building Code , which paragraphs shall read as
follows :
Section 10 , That Chapter 6 of the Fayetteville Code of
Ordinances is hereby amended by adding Sec . 6 - 77 . 1 to read as
follows :
Sec . 6 - 77 . 1 . Sec . 508 . 4 (d ) amended .
Sec . 508 . 4 (d ). of the Building Code is hereby amended
to read as follows :

Section 11 . That Chapter 6 of the Fayetteville Code of
Ordinances is hereby amended by adding Sec . 6 - 78 . 1 . 1 to read
as follows :
Sec . 6 - 78 . 1 . 1 Sec . 1115 . 3 ( c ) amended .
That the first sentence in the second paragraph of
Sec . 1115 . 3 (c ) of the Building Code is hereby amended to
read as follows :
A handrail is required on the narrow side of the
tread on winders when the tread is less than six ( 6 )
inches at its narrowest point .
Section 12 . That the Fayetteville Code of Ordinances is
hereby amended by adding Section 6 - 78 . 1 . 2 to read as follows :

The first sentence in Section 1108 . 1 (b ), of the Building
Code is hereby amended to read as follows :

All porches , balconies , raised floor surfaces or
landings located more than thirty ( 30 ) inches above the
floor or grade below shall have guardrails not less than
thirty- six ( 36 ) inches in height .
Section 13 . That the heading , first sentence and designation
of sub-paragraphs in Sec . 6 - 79 of the Fayetteville Code of
Ordinances are hereby amended to read as follows :
Sec . 6 - 79 . Sections 1302 . 3 ( f ) and ( g ) added .
Paragraphs (f ) and ( g ) are hereby added to Sec . 1302 . 3
of the Building Code , which paragraphs shall read as follows :
Section 14 . That Section 6 - 90 of the Fayetteville Code
of Ordinances its hereby amended to read as follows :
Sec . 6 - 90 . Chapter XXIII deleted .
Chapter XXIII entitled " Signs and Outdoor Displays "
is hereby deleted from the Building Code .
Section 15 . That Chapter 6 of the Fayetteville Code of
Ordinances is hereby amended by adding Sec . 6 - 96 to read as
follows :
Sec . 6 - 96 . Appendix K . Subsection ( e ) Amended .
Appendix K , Subsection ( e ) of the Building Code is hereby
amended to read as follows :
A fee of $ 5 . 00 shall be charged for an original
certificate of occupancy for a new building and a fee
of $ 25 . 00 shall be charged for a certificate of occupancy
when the building has been previously occupied . There
shall be a fee opy of $ . 50 each for additional copies of
certificates of occupancy . For all certificates of
occupancy that must be renewed annually , there shall be
an annual charge of $ 25 . 00
Section 16 , That Chapter 6 of the Fayetteville Code of
Ordinances is hereby amended by adding Sec . 6 - 97 to read as
follows :
Sec . 6 - 97 . Appendix K , Subsection ( f ) Amended .
That Appendix K , Subsection ( f ) of the Building Code is
hereby amended to read as follows :
When the valuation of the proposed construction
exceeds $ 1 , 000 . 00 and a plan is required to be submitted
by Sec . 105 . 3 , a plan-checking fee shall be paid to the
building official when the plans and specifications are
submitted to the building official for checking . Said
plan- checking fee shall be equal to one-half of the
building permit fee as set forth in Sec . 107 . 4 , with the
following exceptions :
(1 ) One , two , three and four family residential
buildings shall be exempt from the plan- checking fee .
( 2 )_ The maximum plan- checking fee shall be $ 1 , 000 . 00 .

Section 17 , The Board of Directors hereby determines that
the City ' s Building Code does not adequately regulate building
construction ; that adequate regulation of building construction
is essential to the public health , safety and welfare ; and
that the passage of this ordinance is necessary to adequately
regulate building construction . Therefore , an emergency is
hereby declared to exist and this ordinance being necessary
for the public health , safety and welfare shall be in full force
and effect from and after its passage and approval .
