AN ORDINANCE AMENDING SECTION 13 - 8 . 1 ( 9 ) OF THE CG/j<<�FN/- L 0 S�
FAYETTEVILLE CODE OF ORDINANCES TO AUTHORIZE AN C�F�} FRq4�
APPEAL TO THE FAYETTEVILLE BOARD OF DIRECTORS FROM k
THE DENIAL BY THE CITY MANAGER OF A NOISE VARIANCE .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 , That Section 13 - 8 . 1 ( g ) of the Fayetteville
Code of Ordinances is hereby amended by adding the following
paragraph :
An applicant who is denied a variance by the City Manager
may appeal to the Fayetteville Board of Directors by
\ filing written notice of appeal with the City Clerk
J\ within ten days from the date of the City Manager ' s
decision . The notice of appeal shall specifically
state the reasons why the applicant considers the City
CJ Manager ' s findings and decision to be in error .
Section 2 , The Board of Directors hereby determines that
the City ' s Noise Ordinance is in need of clarification for
effective administration thereof ; that effective administration
of the City ' s Noise Ordinance is essential to the public health ,
safety and welfare ; and that the passage of this ordinance is
necessary for the effective administration of the City ' s Noise
Ordinance . Therefore , an emergency is hereby declared to exist
and this ordinance being necessary for the public health , safety
and welfare shall be in full force from and after its passage
and approval .
