FAYETTEVILLE CODE OF ORDINANCES TO AMEND THE MINIMUM
LOT WIDTH AND AREA REQUIREMENTS FOR A TOWNHOUSE ; TO
AMEND THE HEIGHT REGULATION FOR BUILDINGS IN EXCESS
OF 20 FEET IN HEIGHT ; AND TO AMEND THE DEFINITION OF
TOWNHOUSE AND DEFINE CONDOMINIUM .
w BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
_ a\ FAYETTEVILLE , ARKANSAS :
Section 1 . That Appendix A , Article 5 , Sec . ( III ) of
the Fayetteville Code of Ordinances is hereby amended by
deleting the following wording :
Lot Width Minimum :
Townhouse . . . . . . . . . . . . . 24 feet
Lot Area Minimum :
Townhouse Development 10 , 000 sq-. . feet
Individual ( Townhouse ) lot 2 , 500 sq . feet
Land area per dwelling unit :
Townhouse . . . . 2 , 500 sq . feet
Section 2 , That Appendix A , Article 5 , Section ( III ) ( E )
of the Fayetteville Code of Ordinances is hereby amended by
adding the following :
There shall be no specific requirements as to minimum
lot width , lot area , or minimum area per dwelling unit ,
for townhouses or condominiums ; but , townhouses and
condominiums shall conform to the district densities ,
yard requirements , height regulations , parking and
access requirements , and all other applicable City
Ordinances ,
Section 3 , That Appendix A . Article 5 , Sec . ( III ) ( F )
of the Fayetteville Code of Ordinances is hereby amended to
read as follows :
(F ) Height Regulations : Any building which exceeds
the height of 20 feet shall be set back from any side
boundary line an additional distance of one foot for
each foot of height in excess of 20 feet .
Section 4 . That Appendix A . Article 5 , Sec . ( IV) ( D )
of the Fayetteville Code of Ordinances is hereby amended by
deleting the following wording :
Lot Width Minimum :
Townhouse . . . . . . . . . . . . . 24 feet
Lot Area Minimum :
Townhouse development 10 , 000 sq .. feet
Individual ( Townhouse ) lot 2 , 500 sq . feet
Land Area per Dwelling Unit :
Townhouse 2 , 500 sq . feet

of the Fayetteville Code of Ordinances is hereby amended by
adding the following :

Townhouse . Two or more single family dwelling units
constructed in a series of attached units with property
lines separating each unit .
Section 8 . That Appendix A , Article 17 of the Fayetteville
Code of Ordinances is hereby amended by adding the following :
Condominium . Two or more single family dwelling units
constructed in a series of attached units and submitted
to a horizontal property regime under Ark . Stats .
§ 50 - 1011 et seq .
