AN ORDINANCE AMENDING ARTICLE IV , SECTION I OF
APPENDIX C TO THE FAYETTEVILLE CODE OF ORDINANCES
TO REQUIRE THE DEVELOPER OF A LARGE SCALE DEVELOPMENT
TO PROVIDE FOR PUBLIC PARKS .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Article IV , Sec . I of Appendix C
to the Fayetteville Code of Ordinances is hereby amended
by amending the first paragraph of subsection ( 2 ) ( d ) to
read as follows :
Comply with those requirement of Article III , Section A
of the subdivision regulations pertaining to streets ,
surface drainage system , water system , sanitary sewer
systems , and if the development is multi - family housing ,
said requrements pertaining to public parks ; and ,
install a sidewalk adjacent to all abutting streets or
highways in accordance with City specifications for
sidewalk construction .
Section 2 . The Board of Directors hereby determines
that the City ' s large scale development regulations do not
make adequate provision for park sites and park facilities ;
that adequate provision for park sites and park facilities when
land is subdivided or developed is essential to the public
welfare ; and that passage of this ordinance is necessary to
make adequate provision for park sites and park facilities .
Therefore , an emergency is hereby declared to exist , and
,( this ordinance begin necessary for the public health , safety
and welfare shall be in full force and effect from and after
its passage and approval .
PASSED AND APPROVED this day of 1981 .
