CIRCUIT CLARK
AN ORDINANCE VACATING AND ABANDONING AN ALLEY
LYING BETWEEN LOT 1 AND LOTS 2 AND 3 OF BLOCK 1
IN NORWOODS SECOND ADDITION NORTHWEST OF BARTON
AVENUE .
WHEREAS , the Board of Directors has the authority under
Ark . Stat . 19 - 2304 to vacate portions of alleys which are not
required for corporate purposes ; and
WHEREAS , the Board of Directors has determined that the
following described alley is a platted alley which is not
required for corporate purposes .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the City of Fayetteville , Arkansas ,
hereby releases , vacates , and abandons all of its rights ,
together with the rights of the public generally , in and to
the following described property :
Beginning at the East corner of Lot 1 , Block 1 , of
Norwood ' s Second Addition to the City of Fayetteville ,
Arkansas ; thence North 51030 ' West 70 . 03 feet ; thence
North 01047 ' 24 " West 26 . 20 feet ; thence South 51030 '
East 86 . 21 feet ; thence along the right-of -way of
Barton Avenue 20 feet to the point of beginning .
Section 2 . As a condition of the abandonment of said
street the City shall be held free and harmless from liability
as to any claims of the contiguous property owners for damages
to the property described herein , which damage may result
from the City , or other utility companies removing and relocating
public utility lines located in or upon said vacated alley .
Section 3 . A copy of this ordinance duly certified by
the City Clerk shall be filed in the office of the Recorder of
the County and recorded in the Deed Records of the County .
