AN ORDINANCE AMENDING SECTION 18 - 31 ( c ) OF THE FRk R
FAYETTEVILLE CODE OF ORDINANCES TO CLARIFY THE
SIDEWALK CONSTRUCTION REQUIREMENTS PRESCRIBED
THEREBY ,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section - 1 . That Section 18 - 31 ( c ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
( c ) The provisions of this section shall only apply
to property :
1 ) On which a new structure is being built ;
2 ) On which an existing residential structure is
being modified so as to increase the number of dwelling
units located therein or to change the use to a nonresidential
use .
Section 2 . The Board of Directors hereby determines
that there is a shortage of sidewalks in the City of Fayetteville ;
that adequate sidewalks are necessary for the public health ,
safety and welfare ; and that the passage of this ordinance
is necessary to provide adequate sidewalks . Therefore , an
emergency is hereby declared to exist and this ordinance
being necessary for the public welfare shall be in full
force and effect from and after its passage and approval .
