PENALTY FOR OVERTIME PARKING IN SAID ZONES .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS : MI (CROFF ILMED
Section 1 . That Section 19 - 169 of the Fayetteville Code
of Ordinances is hereby amended to provide that all parking
meter zones described therein shall be two hour zones .
Section 2 . That Section 19 - 174 ( a ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
"Any vehicle parking or standing in any parking meter
space within a zone established by this division may
lawfully occupy such space for one hour or less for
each 10 cents deposited . "
Section 3 . That Section 19 - 174 of the Fayetteville Code
of Ordinances is hereby amended by adding Paragraph ( 6 ) to read
as follows :
" ( e ) The penalty for each violation of this section
shall be $ 1 . 00 if voluntarily paid within 24 hours
from the violation or $ 2 . 00 if voluntarily paid after
24 hours from the violation . The term "voluntarily
paid" shall mean paid prior to the issuance of a
summons , citation , or arrest warrant . "
Section 4 . The Board of Directors hereby determines that
the City ' s on- street parking meter zones are not adequately
regulated ; that adequate regulation of on- street parking meter
zones is essential to the public health , safety and welfare ;
and that the passage of this ordinance is necessary to enable
adequate regulation of the City ' s on- street parking meter zones .
Therefore , an emergency is hereby declared to exist , and this
Ordinance being necessary for the public health , safety and
welfare shall be in full force and effect from and after its
passage and approval .
