AN ORDINANCE AMENDING CHAPTER 19 , DIVISION 3 , OF THE<� Off
FAYETTEVILLE CODE OF ORDINANCES TO. AMEND THE RATE
STRUCTURE FOR OFF-STREET PARKING FACILITIES AND TO
AMEND THE LEGAL DESCRIPTION OF SAID FACILITIES .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That Section 19 - 185 ( 2 ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
( 2 ) Lots 8 , 9 , 10 , 11 , 12 , 13 , 14 and 15 of Block 30 ,
in the Town ( now City ) of Fayetteville , as designated
upon the original plat of said Town .
Section 2 , That Section 19 - 185 ( 6 ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
(6 ) Lots 7 , 8 , 9 and 10 of Block 17 in the Town (now
City ) of Fayetteville , as designated upon the original
plat of said Town .
Section 3 . That Section 19 - 185 ( 7 ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
( 7 ) Lots 8 , 9 and 10 of Block 13 in the Town ( now
City ) of Fayetteville , as designated upon the original
plat of said Town .
Section 4 . That Section 19 - 185 ( 8 ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
( 8 ) Lots 1 , 2 , Lot 3 , less 52 . 53 feet of equal and
uniform width off the South side thereof , and Lot 12 ,
less 50 feet of equal and uniform width off the South
side thereof of Block 13 in the Town ( now City ) of
Fayetteville , as designated upon the original plat of
said Town .
Section 5 , That Section 19 - 185 ( 9 ) of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
( 91 Part of Block 25 , in the Town ( now City ) of Fayetteville ,
as designated upon the original plat of said Town , and
more particularly described as follows : Beginning at
the Northeast corner of Lot 1 in said Block 25 , thence
West 42 feet ; thence South 49 . 3 feet ; thence West 58
feet ; thence South 58 . 7 feet to the center of a platted
alley ; thence East 100 feet ; thence North 107 feet to
the point of beginning .
Section 6 . That Section 19 - 185 ( 12 ) of the Fayetteville
Code of Ordinances is hereby repealed and Section 19 - 185 ( 13 )
is hereby re-numbered Section 19 - 185 ( 12 ) .

Section 7 . That Chapter 19 , Division 3 of the Fayetteville
Code of Ordinances is hereby amended by adding Section 19 -
189 . 1 to read as follows :
Sec . 19 - 189 . 1 . Deposit of coin required - gated lot .
It shall be unlawful for any person to cause , allow ,
permit or suffer any vehicle operated by him or registered ,
in his name to be parked in a gated off-street parking
lot without the useage fee prescribed by Section 19 - 190
below having first been deposited .
Section 8 . That Section 19 - 190 of the Fayetteville
Code of Ordinances is hereby amended to read as follows :
The following off-street parking rates are hereby
established :
(1 ). For the off- street parking lots described in
Paragraphs (3 ) , ( 8 ) and ( 9 ) of Section 19 - 185 above the
parking meter rate shall be ten ( 10 ) cents for each
hour or twenty- five ( 251 cents for five ( 5 ) hours ;
provided , if any portion of said lots shall be gated ,
the gate entrance fee shall be fifty ( 50 ) cents .
( 2 ). For the off- street parking lots described in
Paragraphs ( 1 ) : and ( 6 ) in Section 19 - 185 above , the
parking meter rate shall be ten ( 10 ) cents per hour ;
provided , if any portion of said facilities shall be
gated , the gate entrance fee shall be fifty ( 50 ) cents .
C3 )_ For the off-street parking lots described in
Paragraphs C21 and (71 in Section 19 - 185 above , the
gate entrance fee shall be fifty ( 50 ) cents .
(4 ), For the off- street parking lots described in
Paragraphs (4 ) , ( 5 ). and ( 13 ) in Section 19 - 185 above ,
the parking meter rate shall be five ( 5 ) cents per
hour .
Section 9 : That Section 19 - 191 of the Fayetteville
Code of Ordinances is hereby amended by adding the following
paragraphs :
It shall be unlawful for any person to cause , allow ,
permit or suffer any vehicle operated by him or registered
in his name to be parked in a gated off-street parking
lot for more than twenty- four (24 ) continuous hours .
Each additional hour or fraction thereof that a vehicle
is parked in violation of this Section shall constitute
a separate offense .
The penalty for each violation of this section shall
be $ 1 . 00 ( One Dollar ) if voluntarily paid within twenty-
four (_24 ) hours of the violation or $ 2 . 00 if voluntarily
paid after twenty- four ( 24 ) hours from the violation .
The term " voluntarily paid " shall mean paid prior to
the issuance of a summons , citation , or arrest warrant.

Section 30 . That Section 19 - 193 of the Fayetteville
Code of Ordinances is hereby repealed .
Section 11 . The Board of Directors hereby determines
that the City ' s off- street parking facilities are not adequately
regulated ; that adequate regulation of off- street parking
facilities is essential to the public health , safety and
welfare ; and that the passage of this Ordinance is necessary
to enable adequate regulation of the City ' s off- street
parking facilities . Therefore , an emergency is hereby
declared to exist , and this ordinance being necessary for
the public health , safety and welfare shall be in full force
and effect from and after passage and approval .1^'
