BE IT ORDAINED BY THE BOARD OF DIRECTORS OF `1WiC1d*- $SF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the first paragraph in Sec . 17B-
11 . 2 ( d) ( 2 ) of the Fayetteville Code of Ordinances is hereby
amended to read as follows :
( 2 ) To hear requests for variances from the literal
provisions of this chapter for the erection of a new
sign in instances where strict enforcement of this
chapter would cause practical difficulties due to
circumstances unique to the individual sign under
consideration , and grant such variance only when it is
demonstrated that such action will be in keeping with
the spirit and intent of this chapter .
Section 2 . The Board of Directors hereby determines
that the jurisdiction of the Board of Sign Appeals is in
immediate need of clarification for effective administration
of the City ' s sign ordinance ; that effective administration
of the City ' s sign ordinance is essential to the public
health , safety and welfare ; and that the passage of this
ordinance is necessary for the immediate clarification of
the jurisidction of the Board of Sign Appeals . Therefore ,
an emergency is hereby declared to exist and this order
being necessary for the public health , safety and welfare
shall be in full force and effect from and after its passage
and approval .
