BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY COFRK A
FAYETTEVILLE , ARKANSAS :
Section 1 . That Section 17 B- 11 . 2 ( d) ( 2 ) ( a) of the
Fayetteville Code of Ordinances hereby amended to read as
follows :
(A) The Board shall not permit as a variance any sign
the erection of which or the continuance of which is
prohibited by Section 17 B- 7 of this Chapter . The
Board may grant a variance from the provisions of Sec .
17 B - 5 ( a) of this Chapter where strict enforcement
of said section would be unreasonable .
Section 2 . The Board of Directors hereby determines
that the jurisdiction of the Board of Sign Appeals needs to
be , amended for effective administration of the City ' s sign
regulations ; that effective administration of the City ' s
sign regulations is necessary for the public health , safety
and welfare ; and that the passage of this ordinance is
necessary to amend the jurisdication of the Board of Sign
Appeals . Therefore , an emergency is hereby declared to
exist , and this ordinance be necessary for the public health ,
safety and welfare shall be in full force and effect from
and after its passage and approval .
