BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CCITYrO�L ERYKE'
� FAYETTEVILLE , ARKANSAS :
Section 1 . That the Board of Directors hereby waives
the requirements of competitive bidding for the purchase of
asphalt emulsion by the Street Department for Slurry - Seal Projects
because said requirements are not feasible for the reason that
there is only one available supplier .
Section 2 . The Board of Directors hereby determines that
the Street Department is in immediate need of asphalt emulsion
to properly maintain the City streets ; the proper maintenance
of City streets is esential to the public health , safety , and
welfare ; and that the passage of this ordinance is necessary to
enable said immediate purchase of asphalt emulsion . Therefore ,
an emergency is hereby declared to exist and this ordinance being
necessary for the public health , safety , and welfare shall be in
full force and effect from and after its passage .
