AN ORDINANCE WAIVING THE REQUIREMENTS 0_' COMPETITIVE
BIDS FOR THE BORING OF A 24" BY 80 ' HOLE UND�R U . S . HIGHWAY
_ \ 71 BY- PASS AT CATO SPRINGS ROAD FOR THE INSTALLATION OF
V A SEWER LINE .
WHEREAS , the City proposes to install a sewer line in
the area of the intersection of U . S . 71 By - pass and Cato
Springs Road ; and
WHEREAS , in order to install said sewer line it will
be necessary to bore a 24" x 80 ' hole under U . S . 71 By - pass
at Cato Springs Road ; and
WHEREAS , there is only one boring contractor in this area .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the Board of Directors hereby waives the
requirements of competitive bidding for the boring of a 24" x 80 '
hole under U . S . 71 By -pass at Cato Springs Road for the
installation of a sewer line because said competitive bidding
requirements are not feasible since there is only one boring
contractor in this area .
Section 2 . The Board of Directors hereby determines that the
immediate installation of a sewer line in the area of the intersection
of U . S . 71 By- pass and Cato Springs Road is necessary to safeguard
the public health , safety and welfare ; and that the passage of
this ordinance is necessary to accomplish said immediate installation .
Therefore , an emergency is hereby declared to exist and
this Ordinance being necessary for the public health , safety
and welfare shall be in full force and effect from and after its
passage .
PASSED AND APPROVED this IT day of 1979 .
