BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF e/FR/Yj��AR'f
FAYETTEVILLE , ARKANSAS :
Section 1 . That Section 6- 71 of the Fayetteville Code of
Ordinances is hereby amended to read as follows :
Paragraph ( c ) is hereby added to Section 113 . 1 of the Code ,
which paragraph shall read as follows :
( c ) The Board of Adjustments and Appeals , when so appealed
to and after a hearing , may vary the application of any
provision of the Electrical Code to any particular case
when , in its opinion , the enforement thereof would do
manifest injustice , and would be contrary to the spirit
and purpose of said Code.; or public interest , or when , in
its opinion the interpretation of the Electrical Inspector
should be modified or reversed . A decision of the Board
of Adjustments and Appeals to vary the application of any
provision of the Electrical Code or to modify an Order of
the Electrical Inspector shall specify in what manner
such variation or modification is made , the conditions
upon which it is made and the reasons therefore .
Section 2 . The Board of Directors hereby determines that
the Fayetteville Code of Ordinances does not presently provide
for a procedure to obtain a variance from the literal provisions
of , the Electr/icallCode ; that the lack of such a procedure creates
an unaue ' ana unnecessary ,burden on the efficient administration
of said,, Code ; that the "immediate adoption of such a procedure is
necessary for `the'' efficient administration of said Code ; and
that, : the passage of , .,this Ordinance is necessary for the immediate
adoption . of such•. ;a procedure . Therefore , an emergency is
hereby , dec,lared : to exist -, - ` and this Ordinance being necessary
for the public welfare shall be in full force and effect from
. and , after its passage and approval .
